Last week, the Sudanese army targeted a humanitarian aid convoy in the city of Malit in North Darfur, in a move that signals a dangerous escalation in the war in Darfur and is a clear violation of international humanitarian law, which prohibits the targeting of humanitarian supplies.<\/span><\/h1>\n

The head of the civil administration in Malit, Al-Ajab Rukza, told Al-Tanweer that the convoy was carrying food and medical aid provided by international and regional organizations and was on its way to disaster-stricken areas where residents are living in dire humanitarian conditions.<\/span><\/h1>\n

He added that the air strike did not result in any casualties among the relief crew, but it caused widespread shock among civilians and organizations working in the region.<\/span><\/h1>\n

He pointed out that this was not the first attack of its kind, but rather part of a series of systematic military operations targeting several civilian areas in Darfur, leading to mass displacement and the near-total collapse of infrastructure.<\/span><\/h1>\n

For their part, human rights organizations have called for an urgent international investigation into the incident, describing the targeting of humanitarian convoys as a \u201cfull-fledged war crime\u201d and calling on the Security Council and the international community to take immediate action to protect civilians and ensure unhindered access to aid.<\/span><\/h1>\n

A worrying trend:<\/span><\/h1>\n

Observers assert that the repeated targeting of humanitarian convoys by the Sudanese Air Force reflects a worrying trend that may amount to a systematic policy aimed at suffocating areas outside the control of the Port Sudan government by depriving them of aid, which constitutes a serious violation of international humanitarian law.<\/span><\/h1>\n

The Malit convoy was not the first to be targeted by the army. Last May, an incident occurred in the town of Al-Kuma, east of El Fasher. Humanitarian organizations reported that the convoy was carrying urgent food and medical aid to areas facing famine.<\/span><\/h1>\n

All parties had been notified in advance of its route through humanitarian coordination channels. Despite this, it was bombed by the army, killing five relief workers and completely destroying four vehicles.<\/span><\/h1>\n

Reactions at the time ranged from condemnation by the UN to local calls for those involved to be held accountable. However, the army did not issue any official statement clarifying the circumstances of the incident or taking responsibility, which contributed to reinforcing accusations that humanitarian convoys were being deliberately targeted.<\/span><\/h1>\n

Aid organizations warn that these attacks put humanitarian workers in constant danger and could lead to the suspension of vital supply programs for millions of civilians trapped in conflict zones, at a time when fighting is escalating and living conditions in Darfur are deteriorating.<\/span><\/h1>\n

Disregard for international law:<\/span><\/h1>\n

Commenting on the army’s bombing of a humanitarian aid convoy in the city of Malit, human rights activist and lawyer Talib Al-Khatim told Al-Tanweer Targeting convoys providing humanitarian aid to civilians in areas of armed conflict is a war crime in every sense of the word and constitutes a violation of the 1949 Geneva Convention on the protection of civilians during war. <\/span><\/h1>\n

Protection extends to those carrying out relief and humanitarian aid operations, according to Article 10 of the same convention.<\/span><\/h1>\n

He considered that any hostile act against relief and humanitarian aid operations is a violation of international and humanitarian law, and failure to comply with it may amount to a war crime that warrants prosecution before the International Criminal Court.<\/span><\/h1>\n

He explained that the worst aspect of this war is the use of starvation as a strategic weapon to punish population groups, especially in areas controlled by the Rapid Support Forces, by preventing humanitarian aid from reaching them in the form of food, clothing, and medicine, which is unethical and illegal under international humanitarian law and international criminal law.<\/span><\/h1>\n

No party to the war has the right to use it, as the policy of starvation against civilians is prohibited under all international conventions. This is clearly stated in Additional Protocol I of 1977, which prohibits the use of starvation as a weapon in all armed conflicts. In 2019, in Switzerland, the Rome Statute was amended to include starvation as a war crime even in non-international conflicts.<\/span><\/h1>\n

The request indicates that the bombing of the UNICEF humanitarian aid convoy in Al-Kuma is a criminal act that constitutes a flagrant violation of international humanitarian law, international criminal law, and the Rome Statute.<\/span><\/h1>\n

This is evidenced by the prevention of any humanitarian aid from reaching civilians by targeting humanitarian relief convoys, which makes the army liable to for committing a war crime by using starvation as a weapon against civilians.<\/span><\/h1>\n

Hostility towards civilians:<\/span><\/h1>\n

Lawyer and legal advisor Yaqoub al-Tajani says that the Sudanese army’s use of air power to target relief convoys reflects hostility towards civilians and not just the warring parties, which contravenes all established rules of international humanitarian law, especially in non-international conflicts, as is the case in Sudan.<\/span><\/h1>\n

In an interview with Al-Tanweer, he pointed out that the repetition of such acts reinforces the hypothesis of criminal intent, i.e., that the bombing was not accidental or the result of an error in judgment, but rather part of a systematic policy to starve and exterminate the population in certain areas.<\/span><\/h1>\n

He also explained that documenting these violations with testimonies and field reports could form a solid legal basis for opening an international investigation, either by the International Criminal Court or through United Nations fact-finding commissions.<\/span><\/h1>\n

He concluded by saying that continuing to ignore these crimes or delaying international action sends negative messages that exacerbate the suffering of victims and perpetuate impunity, requiring a decisive legal and moral stance from the international community.<\/span><\/h1>\n

Criminalization of attacks on facilities:<\/span><\/h1>\n

In addition, lawyer and human rights defender Hatem Elias says that international humanitarian law is a set of rules that seek to limit the effects of armed conflicts and protect people who are not participating in hostilities or have ceased to participate in them, while imposing restrictions on the means and methods of warfare.<\/span><\/h1>\n

It is also known as the \u201claw of war\u201d or the \u201claw of armed conflict,\u201d a branch of public international law that includes treaties, customary law, and general principles of law.<\/span><\/h1>\n

He points out that international humanitarian law clearly criminalizes attacks on civilian facilities and, therefore, attacks on international aid convoys carrying life-saving food and medicine are considered war crimes and require accountability.<\/span><\/h1>\n

Elias emphasized that the direct impact of this is to deprive civilians in war zones of access to aid and also to attack international relief workers and staff. Certainly, organizations will not work in such conditions to help those in need, but will withdraw their teams from the area, depriving civilians in war zones of the aid they need.<\/span><\/h1>\n

He explained that if a transparent investigation proves that the army bombed the relief convoy, then the goal is to prevent aid from reaching areas controlled by the Rapid Support Forces on the pretext that the Rapid Support Forces are using that aid for themselves or for civilian groups loyal to them.<\/span><\/h1>\n

There is also an excuse given by the army that the Rapid Support Forces are exploiting relief convoys to transport weapons and military supplies.<\/span><\/h1>\n
